Financial Services Regulation

Malta has over the past 30 years developed into a reputable Financial Services Centre which attracts international investors to set up and operate from Malta. The Maltese jurisdiction has seen a considerable number of companies operating from here including international Banks, Financial Institutions, EMIs, Investment Service Providers, Funds, AIFs and Insurance & Captive companies.

Advocates Primei has the expertise to assist such companies with any necessary legal and regulatory support both during the set-up phase and also on an ongoing basis. Having built a strong understanding of the laws and rules governing the sector and also having a good reputation with the single regulator, the Malta Financial Services Authority (MFSA), ensures that we can assist clients with all their legal and regulatory needs.

We have assisted various clients with the necessary planning and structuring which precedes a formal application, and also with the eventual preparation and review of the Application documents.

We have also assisted various clients in proposed take overs of licenced entities, which process also requires the vetting and approval of the Regulator.

Financial Services Litigation

Advocates Primei has a team of experienced lawyers that have been active in various litigation related to Financial Services.

We have assisted clients with representations with the Regulator in terms of alleged regulatory breaches. We have also experience with filing appeals from decisions of the Malta Financial Services Authority (MFSA), which appeals are lodged in front of the Financial Services Tribunal (FST).  We have also assisted end clients with actions for damages against Banks, Insurances or Investment Service Providers for various breaches such as mis-selling.

We have also experience with financial services litigation in front of the Maltese Civil Courts and in front of the Office of the Arbiter for Financial Services (OAFS). We have also represented Service Providers in similar litigation and also assisted licenced entities in voluntary liquidations and court winding up procedures.
